CIVIL PROCESS

 The civil section at the Holmes County Sheriff’s Office is part of the Administration Division and consists of the Enforceable Unit, the Non- Enforceable Unit and Civil Process Unit. The responsibility of this section is to effect the service and / or enforcement of all judicial process, both enforceable and non- enforceable, originating from the Supreme Court, Circuit Court, County Courts and Board of County Commissioners as this is part of the duties and powers of the Sheriff, pursuant to Chapter 30.15(1) Florida Statutes.


PROCEDURES AND FEES FOR CIVIL PROCESS SERVICE


Non Enforceable Writs:  Witness Subpoena, Summons, Garnishment, Notice to Appear and Order to Show Cause.  The fee is $40.00.  If filed electronically send two copies of summons, if not send original or certified copy of summons along with one copy of summons and a copy of the complaint along with self addressed stamped envelope.  Please allow two weeks for return of service. 


Enforceable Writs:  Writ of Possession or Replevin. The fee is $90.00 each. If filed electronically send two copies of summons, if not send one original or certified copy of writ along with one copy of writ and a copy of the final judgement along with self addressed stamped envelope.  Please allow two weeks for return of writ.


Levy Deposits:  Automobiles, Boats - per unit minimum fee of $2000.00 (Larger size vehicle or vessel requires inquiry of towing and storage cost estimates; thus, a possible higher deposit.)  Real Estate fee is $1000.00.
